(Braintree District) (Prohibition of Waiting, Loading and Stopping) and (On-Street Parking Places) (Civil Enforcement Area) (Amendment No.23) Order 2022

Notice is hereby given Colchester Borough Council acting on behalf of the North Essex Parking Partnership in exercise of the delegated powers of the traffic authority Essex County Council granted under an Agreement dated 31 March 2011 Has Made the above Order under Sections 1(1), 2(1) to (3), 4(1), 4(2), 32, 35, 45, 46, 49 and 53 and Parts III and IV of schedule 9 of the Road Traffic Regulation Act 1984. The effect of the Order: This Order will be incorporated into The Essex County Council (Braintree District) (Prohibition of Waiting, Loading and Stopping) and (On-Street Parking Places) (Civil Enforcement Area) Consolidation Order 2019 'the 2019 Order' by:

1. The following definition in Article 3 of the 2019 Order listed in this Notice as Article 1(a), shall be replaced by the following definition in Article 1(b) of this Notice:



(a) "The 2007 Regulations" means the Civil Enforcement of Parking Contraventions (England) General Regulations 2007;



(b) "The 2022 Regulations" means the Civil Enforcement of Road Traffic Contraventions (Approved Devices, Charging Guidelines and General Provisions) (England) Regulations 2022.



2. The following definition in Article 3 of the 2019 Order listed in this Notice as Article 2(a), shall be replaced by the following definition in Article 2(b) of this Notice:



(a) "Penalty Charge Notice" has the same meaning given by Regulation 8(1) of the 2007 Regulations;



(b) "Penalty Charge Notice" means a notice described in Section 78 of the 2004 Act having effect as if issued or served by a Civil Enforcement Officer or posted by the enforcement authority under any regulations for the time being in force under Section 78 of the 2004 Act.



3. The following provisions in Article 109 of the 2019 Order listed in this Notice as Article 3(a), shall be replaced by the following provisions in Article 3(b) of this Notice:



(a) The Penalty Charge shall be payable not later than 16.00 hours on the Applicable Date subject to the provisions of the Penalty Charge and the 2007 Regulations;



(b) The Penalty Charge shall be payable not later than 16.00 hours on the Applicable Date subject to the provisions of the Penalty Charge and the 2022 Regulations.

Application to the high court: Anyone who wishes to question the validity of the Order of any provision contained in it on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984 or on the grounds that any requirement of the Act,

or any instrument made under it, has not been complied with in relation to the Order, may within six weeks from the date of the making of the Order apply to the High Court for this purpose.

(The Green, Finchingfield) (Temporary Prohibition of Traffic)

& (The Causeway/The Green/Bridge Street/Brent Hall Road & The Green, Finchingfield) (Temporary Introduction of a Clearway) Order 2022

Notice is hereby given that the Essex County Council intends, not less than seven days from the date of this notice, to make the above Order under section 14(1) of the Road Traffic Regulation Act 1984. Effect of the order:

1. To temporarily close that length of The Green, Finchingfield in the District of Braintree, from its junction with Sunnyside to its junction with The Causeway a distance of approximately 40m.



2. To temporarily introduce a 'No Waiting, No Loading and No Stopping' restriction in that length of The Causeway, Finchingfield in the District of Braintree, from its junction with The Green for a distance of approximately 30m in a north easterly direction, and from its junction with Church Hill for a distance of approximately 55m in northerly direction.



3. To temporarily introduce a 'No Waiting, No Loading and No Stopping' restriction in that length of The Green, Finchingfield in the District of Braintree, from its junction with The Causeway to its junction with Church Hill a distance of approximately 45m.



4. To temporarily introduce a 'No Waiting, No Loading and No Stopping' restriction in that length of Bridge Street, Finchingfield in the District of Braintree, from its junction with The Green to its junction with Church Hill a distance of approximately 70m.



5. To temporarily introduce a 'No Waiting, No Loading and No Stopping' restriction in that length of Brent Hall Road, Finchingfield in the District of Braintree, from its junction with Green Road to its junction with The Green a distance of approximately 60m.



6. To temporarily introduce a 'No Waiting, No Loading and No Stopping' restriction in that length of The Green, Finchingfield in the District of Braintree, from its junction with Brent Hall Road to its junction with Bardfield Road a distance of approximately 95m.



"The Essex County Council (Braintree District) (Prohibition of Waiting, Loading and Stopping) and (On Street Parking Places) (Civil Enforcement Area) Consolidation Order 2019" will be temporarily amended to include the temporary 'No Waiting, No Loading and No Stopping at Any Time' restriction and suspend any existing parking and waiting restrictions on the above lengths of roads only. All other restrictions and exemptions contained in the aforementioned Order and Amendments to that Order shall remain in force. The closure/restrictions are scheduled to commence on 16th July 2022 for 2 days and again 23rd July 2022 for 2 days (weekends only), or where stated on a valid permit (EP201EH10003513 - Essex County Council). The scheduled dates may vary for these works with appropriate signs showing and/or displayed on one.network. The closure/ restrictions are required for the safety of the public and workforce while ground investigation works are undertaken by Essex County Council. An alternative route is available via Brent Hall Road, Sampford Road, Hawkins Hill, Finchingfield Road, Hill Road, High Street, Moor End Road, Anso Road, Bumpstead Road, Hempstead Road, Water Lane, Church Street, Old Hall Road, Eggshell Lane, Cornish Hall End, Little London Hill, Howe Street, Duck End, The Causeway and vice versa. The Order will come into effect on 23rd June 2022 and may continue in force for 18 months or until the works have been completed, whichever is the earlier.

(Kentish Farm Road, Stisted) (Temporary Prohibition of Traffic) Order 2022

Notice is hereby given that the Essex County Council intends, not less than seven days from the date of this notice, to make the above Order under section 14(1) of the Road Traffic Regulation Act 1984.

Effect of the order: To temporarily close that length of Kentish Farm Road, Stisted in the

District of Braintree, from its junction with White House Road for a distance of approximately

455m in a north easterly direction. The closure is scheduled to commence on 12th July 2022

for 4 days, or where stated on a valid permit (KA160LT001-E-HHGABE - Gigaclear Ltd). The

scheduled dates may vary for these works with appropriate signs showing and/or displayed

on one.network. The closure is required for the safety of the public and workforce while fibre

optic broadband installation works are undertaken by Gigaclear Ltd.

An alternative route is available via Boultwood Farm Road, Rayne Hatch Wood Road,

Halstead Road, High Garrett, Lyons Hall Road and vice versa.

The Order will come into effect on 23rd June 2022 and may continue in force

for 18 months or until the works have been completed, whichever is the earlier.

(Halstead Road, Colne Engaine) (Temporary Prohibition of Traffic) Order 2022

Notice is hereby given that the Essex County Council intends, not less than seven days from the date of this notice, to make the above Order under section 14(1) of the Road Traffic Regulation Act 1984.

Effect of the order: To temporarily close that length of Halstead Road, Colne Engaine in the District of Braintree, from a point approximately 960m north west then west of its junction with Station Road for a distance of approximately 80m in a westerly then north westerly direction. The closure is scheduled to commence on 12th July 2022 for 3 days, or where stated on a valid permit (AD03159766242/3 - Anglian Water). The scheduled dates may vary for these works with appropriate signs showing and/or displayed on one.network. The closure is required for the safety of the public and workforce while stoptap replacement works are undertaken by Anglian Water. An alternative route is available via Station Road, Elms Hall Road, Halstead Road, Stonebridge Hill, Parley Beams, Colchester Road, Fenn Road and vice versa with access only into Halstead Road and Brook Street.

The Order will come into effect on 23rd June 2022 and may continue in force for 18 months or until the works have been completed, whichever is the earlier

(Peg Millars Lane, Fairstead) (Temporary Prohibition of Traffic) Order 2022

Notice is hereby given that the Essex County Council intends, not less than seven days from the date of this notice, to make the above Order under section 14(1) of the Road Traffic Regulation Act 1984.

Effect of the order: To temporarily close that length of Peg Millars Lane, Fairstead in the District of Braintree, from its junction with Fairstead Road to its junction with Troys Lane a distance of approximately 1465m. The closure is scheduled to commence on 11th July 2022 for 8 days, or where stated on a valid permit (KA160LT010-E-TERLING - Gigaclear Ltd). The scheduled dates may vary for these works with appropriate signs showing and/ or displayed on one.network. The closure is required for the safety of the public and workforce while fibre optic broadband installation works are undertaken by Gigaclear Ltd. An alternative route is available via Peg Millars Lane, Witham Road, Hatfield Road, Fairstead Road and vice versa.

The Order will come into effect on 23rd June 2022 and may continue in force for 18 months or until the works have been completed, whichever is the earlier.

(Burtons Green Road, Greenstead Green) (Temporary Prohibition of Traffic) Order 2022

Notice is hereby given that the Essex County Council has made the above Order under section 14(1) of the Road Traffic Regulation Act 1984.

Effect of the order: To temporarily close that length of Burtons Green Road, Greenstead Green in the District of Braintree, from a point approximately 110m south east of its junction with Grange Hill for a distance of approximately 110m in a north easterly direction. The closure is scheduled to commence on 29th June 2022 for 3 days, or where stated on a valid permit (AD03160346251 - Anglian Water). The scheduled dates may vary for these works with appropriate signs showing and/or displayed on one.network. The closure is required for the safety of the public and workforce while stop tap replacement works are undertaken by Anglian Water.

An alternative route is available via Church Road, Crocklands, Crocklands Corner and vice versa with access only into Burton's Green Road and Parley Beams Road. The Order came into effect on 9th June 2022 and may continue in force for 18 months or until the works have been completed, whichever is the earlier.

(Little London Hill, Finchingfield) (Temporary Prohibition of Traffic) Order 2022

Notice is hereby given that the Essex County Council has made the above Order under section 14(1) of the Road Traffic Regulation Act 1984.

Effect of the order: To temporarily close that length of Little London Hill, Finchingfield in the District of Braintree, from its junction with Howe Street for a distance of approximately 1880m in a north easterly direction. The closure is scheduled to commence on 27th June 2022 for 5 days, or where stated on a valid permit (EP201EH2313155 - Essex County Council). The scheduled dates may vary for these works with appropriate signs showing and/or displayed on one.network. The closure is required for the safety of the public and workforce while carriageway patching works are undertaken by Essex County Council. An alternative route is available via Howe Street, Duck End, The Causeway, The Green, Brent Hall Road, Sampford Road, Hawkins Hill, Finchingfield Road, Hall Road, Hill Road, High Street, Moor End Road, Walden Road, Anso Road, Bumpstead Road, Hempstead Road, Water Lane, North Street, Haverhill Road, Chapel Street, Old Hall Road, Eggshell Lane, Cornish Hall End and vice versa.

(Station Road, Birdbrook) (Temporary Prohibition of Traffic) Order 2022

Notice is hereby given that the Essex County Council has made the above Order under section 14(1) of the Road Traffic Regulation Act 1984.

Effect of the order: To temporarily close that length of Station Road, Birdbrook in the District of Braintree, from its junction with Birdbrook Road for a distance of approximately 440m in a northerly direction. The closure is scheduled to commence on 27th June 2022 for 19 days, or where stated on a valid permit (BC411SAWCTG984T001 - Openreach). The scheduled dates may vary for these works with appropriate signs showing and/or displayed on one.network. The closure is required for the safety of the public and workforce while new duct works are undertaken by Openreach. An alternative route is available via Baythorne End, Ridgewell Road, Four Ash Hill, The Causeway, Birdbrook Road and vice versa with access only into Station Road. The Order came into effect on 9th June 2022 and may continue in force for 18 months or until the works have been completed, whichever is the earlier.

(Terling Hall Road, Terling) (Temporary Prohibition of Traffic) Order 2022

Notice is hereby given that the Essex County Council has made the above Order under section 14(1) of the Road Traffic Regulation Act 1984. Effect of the order:

1. To temporarily close that length of Terling Hall Road, Terling in the District of Braintree, from its junction with Flacks Green to its junction with Rolls Farm Lane a distance of approximately 805m.



2. To temporarily close that length of Terling Hall Road, Terling in the District of Braintree, from its junction with Rolls Farm Lane for a distance of approximately 405m in a south easterly direction.



The closures are scheduled to commence on 30th June 2022 for 8 days, or where stated on a valid permit (KA160LT001-E-TERLING - Gigaclear Ltd). The scheduled dates may vary for these works with appropriate signs showing and/or displayed on one.network. The closures are required for the safety of the public and workforce while fibre optic broadband installation works are undertaken by Gigaclear Ltd. An alternative route is available via Rolls Farm Lane, Waltham Road, Oakfield Lane, Gambles Green, Flacks Green, Church Road (closure 1) and vice versa or Terling Hall Road, London Road, The Street, Station Road, Terling Road, Hatfield Road, New Road, The Street, Church Road and vice versa (closure 2).

The Order came into effect on 9th June 2022 and may continue in force for 18 months or until the works have been completed, whichever is the earlier.

(Various Roads, Braintree) (Temporary Prohibition of Traffic & Temporary Introduction of 30mph Speed Limit), (Temporary Introduction of Clearway) (Streetworks No.2) Order 2022

Notice is hereby given that the Essex County Council has made the above Order under section 14(1) of the Road Traffic Regulation Act 1984. Effect of the order:

1. To temporarily close those lengths of roads in the District of Braintree, as detailed in the Schedule.



2. To temporarily introduce a 30mph speed limit in those lengths of roads as detailed in the Schedule.



3. A temporary 'No Waiting, No Loading and No Stopping' restriction will be introduced on both sides of carriageway on those lengths of roads as specified in the schedule for the duration of the restrictions in order to facilitate the works. Signs will be installed indicating when the No Waiting restriction will be in force.



4. "The Essex County Council (Braintree District) (Prohibition of Waiting, Loading and Stopping) and (On Street Parking Places) (Civil Enforcement Area) Consolidation Order 2019" will be temporarily amended to include the temporary 'No Waiting at Any Time' restriction and suspend any existing parking and waiting restrictions on the above lengths of roads only. All other restrictions and exemptions contained in the aforementioned Order and Amendments to that Order shall remain in force.



The works are scheduled to commence on 9th June 2022, as stated on a valid permit.

The scheduled dates may vary for these works with appropriate signs showing and/or

displayed on one.network. The roads will be closed to facilitate each phase and then

re-opened to the public. Access will be maintained for emergency services. Diversion

routes will be signed at each location and residents will be informed of the dates of each

phase via letter/leaflet drop and advanced warning signs on the road.

The restrictions are required for the safety of the public and workforce while superfast

broadband installation works are undertaken by Gigaclear.

The Order came into effect on 9th June 2022 and may continue in force for 18 months

or until the works have been completed, whichever is the earlier.
